Conditions of sale
These general conditions of sale (the"General Conditions") constitute the conditions applicable to the sale of the products (the"Products") marketed by Lombarda cornici Snc, a company with registered office in Via G. Marconi, 24, 20080 Vermezzo (MI) - Italy, VAT number IT12860880157, through its website www.lombardacornici.it (the"Site") and in general to the relationships between Lombarda cornici Snc and the buyers of the products marketed through the Site (each, the"Customer"). Every time the Customer places an order on the Site, he will be expressly asked to accept the General Conditions and this acceptance will be worth full and complete acceptance by the Customer of all the terms contained in the General Conditions in force on the date of the order and acceptance of the note that Lombarda cornici Snc does not consider itself bound to different conditions, unless previously agreed in writing with the Customer. The Customer is therefore required to carefully read the General Conditions. Lombarda cornici Snc reserves the right, at its sole discretion, to modify, extend, cancel in whole or in part, at any time and without notice, any part of the General Conditions. The changes will come into force as soon as they are published on the Site.

1. Products:prices and characteristics
1.1 Unless otherwise indicated, the prices of the Products published on the Site are expressed in Euros, excluding delivery costs.
Shipments outside the European Community (extra EU) are also net of any customs duties, which will be paid by the recipient and will be requested by the sender at the time of delivery.
The price guaranteed to the buyer is the one published on the Site at the time the order is sent. The purchase price is fixed and definitive.
The prices of the Products published from time to time on the site cancel and replace the previous ones and are subject to the actual availability of the Products. Product images are indicative and not contractual.
The Products are not provided for testing. Although the site operators can provide information on the characteristics of the Products, the Customer is responsible for the choice of the Products ordered as well as for the correspondence and conformity of the specifications indicated by each manufacturer to their needs.

2. Orders
Each order of Products sent to Lombarda cornici Snc constitutes a contractual proposal from the Customer. The execution of the order by Lombarda cornici Snc is equivalent to confirmation and acceptance of the same.

3. Execution of the order
The order will be executed under the conditions specified on the Site.
In the event of failure to execute the order by Lombarda cornici Snc (if this is due to unavailability of the Products ordered by the Customer), Lombarda cornici Snc will communicate to the Customer as soon as possible the expected delivery times for the supply of the missing Product. . If the Customer does not intend to wait for this deadline, Lombarda cornici Snc will refund the sums already paid by the Customer for the supply not carried out.
In the event of a breakdown, exhaustion of stock(es) or unavailability of the Product ordered, Lombarda cornici Snc undertakes to inform the Customer as soon as possible and to indicate a period of availability.
The Customer will confirm his choice by email, or wait for the Product to be available or request a refund.

4. Acceptance of the order
The conclusion of the contract will take place only after confirmation of the order by Lombarda cornici Snc

The Customer will receive by fax, post or e-mail an acknowledgment of receipt containing the order confirmation with all the elements constituting the contract (products ordered, prices, shipping costs, etc.)

Lombarda cornici Snc reserves the right not to confirm an order for any reason related in particular to a problem with the supply of products, or a problem relating to the order received.

5. Delivery of the Products
The Products will be delivered to the address indicated by the Customer.

Shipments will take place after receiving the payment confirmation:for payment by credit card, confirmation of the transaction by the circuit, for payments by bank transfer there must be the actual balance recorded by the receiving bank.
For our shipments we rely on the express courier service. The terms depend on the carrier and are communicated as an indication at the time of order confirmation.


It is important to know that:
Upon delivery, the Customer is required to verify the content, conformity and condition of the Product(s). Therefore, at the time of delivery, Lombarda cornici Snc recommends that the Customer check the status of the Products delivered before signing the acknowledgment of receipt, and in particular:
- that the number of packages delivered corresponds to what is indicated in the transport document attached to the shipment;
- that the packaging is intact, not damaged, wet or otherwise altered, and to check the integrity of the contents.
If the Customer detects anomalies, he must formulate his detailed and dated reservations in writing. If the carrier's document is signed without placing a"reservation", the Customer will not be able to make any objection regarding the external characteristics of what was delivered. Any problem regarding the physical integrity, correspondence or completeness of the Products received must be reported within 3 (three) days of delivery.
Lombarda cornici Snc has the right, at its sole discretion, to deliver the Products ordered via a courier of your choice.
Unless otherwise indicated, all deliveries are made at street level.
Special delivery conditions must be previously agreed between the Customer and Lombarda cornici Snc and accepted in writing by Lombarda cornici Snc

6. Receipt of products in the absence of the customer
In case of absence of the recipient at the time of delivery, the carrier will leave a notice of passage at the delivery address indicated by the Customer. The Products must be collected at the address and in the manner indicated by the carrier.

7. Force majeure
In addition to those normally considered by jurisprudence, the following cases are expressly considered cases of force majeure:
- total or partial strikes, internal or external to the company, blocking of means of transport or supply for any reason, governmental or legal restrictions, IT failures, blocking of telecommunications networks including and in particular of the Internet. In case of failure to collect within the deadline established by the carrier if the Products are returned to Lombarda cornici Snc, which reserves the right to refund the price of the Products, leaving the shipping costs and any other charges connected to the shipment to be paid by the Customer.

10. Payment
Payment for the order/counterparty's order is due from the time of placing the order.
The Customer undertakes to pay the agreed price for the Product ordered on the Site (price of the Products and transport).
The Customer pays for his order via major credit cards or by bank transfer, any other forms of payment must be agreed between the parties. The Customer guarantees Lombarda cornici Snc that he has the necessary authorizations to use the payment method when ordering. To manage payment services, the Site uses an external operator who uses a secure payment form through which the data provided by the Customer is encrypted.

11. Non-payment - Retention of title
The Products ordered remain the property of Lombarda cornici Snc until the final and full payment of their price (pursuant to art. 1523 et seq. of the Civil Code)

12. Complaints
Complaints for non-compliance of the Product(s) delivered with the order must be addressed in writing directly to Lombarda cornici Snc, immediately after receipt of the goods.
The Customer is advised to keep the original packaging and the delivery document.

The computerized processing of information, including the management of the email addresses of users of the site, is carried out in compliance with the provisions of the law.
The personal information requested from the Customer is essential for the processing and delivery of orders, the issuing of invoices and any guarantee contracts.

14. Electronic signature
The"validate click"constitutes an electronic signature.
This electronic signature has the same value between the parties as a handwritten signature.

15. Waiver for non-compliance
For Lombarda cornici Snc, the fact of not asserting a violation by the Customer of any of its obligations cannot be interpreted as a waiver of the obligation in question and the possibility of asserting such violation subsequently.

16. Integrity of the contract
These general conditions of sale constitute the entire obligations of the parties.
No other general or specific conditions communicated by the Customer can enter or be outside these general conditions.

17. Intellectual property
Lombarda cornici Snc is the owner of the intellectual property rights of the Site and the right to distribute the elements contained in the catalog of the online store, consequently the partial or total reproduction, on any type of support, of the elements that make up the Site and catalogue, their use and their transfer to third parties are strictly prohibited.

18. Nullity
If one or more provisions of these general conditions are deemed invalid or declared as such by law, regulation or following a final decision taken by a competent court, the other provisions will retain all their force and value.

19. Jurisdiction
in the event of a dispute and in the absence of an amicable agreement between the parties, the Court of Milan (Italy) will have exclusive jurisdiction for any dispute between the parties regarding this contract.

In application and for the application of the articles. 1341 and 1342 cc, the Customer declares to have carefully read and understood and to expressly accept the following clauses of the General Conditions of Sale.

20. Absence of additional guarantees
All Products are sold"as is"and Lombarda cornici Snc makes no representations or warranties of any kind, express or implicit, with respect to the Products (including implicit warranties of merchantability, anti-counterfeiting and suitability). Under no circumstances will Lombarda cornici Snc be held responsible for any inconvenience or damage resulting from the use of the Site or in relation to the services rendered through the Site.

21. Privacy Policy
The Customer's personal data collected by Lombarda cornici Snc when browsing the Site or during operations relating to the purchase of Products, are collected and processed by Lombarda cornici Snc according to the terms contained in the Privacy Policy available on the Site. By consulting the Privacy Policy , the customer gives his express consent to the processing and communication of his personal data for the purposes and in the manner described in the Privacy Policy.
